This Notice describes how medical information about you may be used and disclosed and how you can access this information. Please review it carefully.
About This Notice
EHN Health USA (“Provider”) is committed to maintaining the privacy and confidentiality of your health information. This Notice of Privacy Practices (“Notice”) explains how we collect, use, disclose, and safeguard your protected health information (PHI) as required by law. This Notice applies to all services provided by EHN Health USA, including Substance Use Disorder (SUD) Intensive Outpatient (IOP) and Outpatient (OP) treatment, as well as Mental Health OP treatment, peer support, and recovery coaching.
How We Use and Disclose Your Health Information
EHN Health USA protects your PHI from unauthorized access, use, and disclosure. We will only use or disclose your PHI as outlined below:
1. Uses and Disclosures for Treatment, Payment, and Health Care Operations
- Treatment & Care Management: We may use and share your PHI with healthcare professionals involved in your care to coordinate your treatment and services, including individual therapy, group therapy, and aftercare programs.
- Payment: We may use and disclose your PHI to obtain payment for services provided to you, including verifying benefits, obtaining prior authorizations, and billing health insurance providers, including Federal and State programs.
- Health Care Operations: We may use and disclose PHI for quality assessment, staff training, compliance audits, and other administrative functions necessary to support our services.
2. Uses and Disclosures Without Your Consent or Authorization
- As Required by Law: We will disclose PHI when required by federal, state, or local laws.
- Public Health Activities: We may report information for disease control, FDA-regulated product safety, child abuse or neglect, and other public health concerns.
- Victims of Abuse, Neglect, or Domestic Violence: We may report suspected abuse, neglect, or domestic violence when required by law.
- Health Oversight Activities: We may provide PHI to government agencies for audits, inspections, and compliance monitoring.
- Judicial and Administrative Proceedings: We may disclose PHI in response to court orders or subpoenas.
- Law Enforcement: We may share PHI with law enforcement to comply with legal requests.
- Decedents: We may provide PHI to coroners, medical examiners, or funeral directors.
- Organ Donation: We may disclose PHI for organ procurement and donation purposes.
- Research and Data Analysis: We may use or disclose PHI for research and publication purposes. If we engage in research or studies, all data used will be de-identified whenever possible. Any identifiable PHI used in research will require your specific authorization unless otherwise permitted by law.
- Health & Safety: We may disclose PHI to prevent serious threats to health and safety.
- Specialized Government Functions: PHI may be shared with the military, national security, or intelligence agencies when required.
- Workers’ Compensation: We may disclose PHI for workers’ compensation claims.
- Individuals Involved in Your Care: If permitted by law, we may share relevant PHI with family members or others involved in your care.
- Appointments & Treatment Alternatives: We may contact you regarding appointment reminders or alternative treatments.
3. Incidental Disclosures
- Limited incidental disclosures of PHI may occur as a by-product of authorized uses, but safeguards are in place to minimize these occurrences.
4. Special Protections for Certain Health Information
- PHI related to HIV status, genetic information, substance use disorder treatment, and mental health treatment has additional confidentiality protections under federal and state law. We will follow these protections as required.
5. Obtaining Your Authorization for Certain Uses and Disclosures
- Certain uses of PHI require your written authorization, including:
o Psychotherapy notes (where applicable)
o Marketing purposes
o Sale of PHI - You may revoke your authorization at any time, except when we have relied on it
to provide care.
Your Rights Regarding Your Health Information
- Right to Inspect and Copy: You may request access to your medical records. Fees may apply.
- Right to Request Amendments: You may request corrections to inaccurate or incomplete information.
- Right to an Accounting of Disclosures: You may request a list of certain disclosures made within the past six years.
- Right to Request Restrictions: You may request limits on how your PHI is used or disclosed. We may not be able to accommodate all requests.
- Right to Confidential Communications: You may request communications via alternative methods or locations.
- Right to Receive Notification of a Breach: If a breach of unsecured PHI occurs, we will notify you as required by law.
- Right to a Paper Copy of this Notice: You may request a paper copy of this Notice at any time.
Filing a Complaint
If you believe your privacy rights have been violated, you may file a complaint with EHN Health USA or with the Secretary of the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.
Changes to This Notice
HN Health USA may update this Notice at any time. The revised Notice will apply to all PHI, past and present, and will be made available upon request.
